The Republican Party has been trotting out the “Dept of Education is unconstitutional” argument since at least Reagan’s days. They claim it is an infringement on “states’ rights.” Even after we have effectively proven that the “states’ rights” argument is code for “segregation”, they still like to use it.
Ronald Reagan, who’s dead BTW (in case any right wingers out there hadn’t noticed) really made it his mission in life to destroy the public education system in this country. He even tried to prevent kids from getting nutricious meals served at lunch.
The people who claim that the Dept of Ed is unconstitutional because of the Tenth Amendment are forgetting that Article I, Section 8, Clause 1 says that Congress shall have power to “provide for the common Defence and general Welfare of the United States.” Establishing education standards in thsi country is providing for the general Welfare. Just because the right wing thinks an uneducated public is a better public does not mean they are right. An uneducated public is only better for the right wing, nott he country as a whole. They oppose spending on public education because they oppose an educated public.
