Well, the election is over and most races have a declared winner and a concession from the loser(s). Slighty more than half the votes will be pleased. And those who sat this one out, well, they’ll just have to take whatever they get, or give up whatever will now be taken away.

This is our Open Thread. Please feel free to add your thoughts on this, or any other topic that comes to mind.

NY county says in Spanish that election is Nov. 9

Real Clear Politics (AP)

A suburban New York county sent an official mailer telling thousands of voters in Spanish that Election Day is Nov. 9, then spent the weekend making automated calls to alert people to the mistake.

A Hispanic organization’s director said some voters still might be confused.

“I think most people do know when Election Day is, but if you get an official letter from the Board of Elections that tells you another day, you might be confused,” said Grace Heymann, director of the Westchester Hispanic Coalition.

“I would especially worry about first-time voters,” she said. “We have been working hard to get out the vote, and we are getting some questions because of this letter.”

The mailing, about the availability of ballot marking devices used by disabled voters, was in English and Spanish. The English part was correct, but the Spanish section said Election Day was Nov. 9 instead of Nov. 4.

Voter documents found on Tampa highway

Election Day isn’t even here yet, but we already have our first voting mystery.

Thousands of pages of voter information were found lying along the shoulder of Interstate 4 this morning.

The papers, all with information about HillsboroughCounty voters, have been cleaned up and taken to a Department of Transportation maintenance facility for now, but voting officials still don’t know where they came from..

..The Hillsborough County supervisor of elections says it did not come from his office, but looks like it may have come from a campaign office or a grassroots effort which drives voters to polling paces.  The documents contain names, addresses, phone numbers, and party affiliation, and if the voter needs a ride..

Documents reveal how Ohio routed 2004 voting data through company that hosted external Bush Administration email accounts:

Newly obtained computer schematics provide further detail of how electronic voting data was routed during the 2004 election from Ohio’s Secretary of State’s office through a partisan Tennessee web hosting company.

A network security expert with high-level US government clearances, who is also a former McCain delegate, says the documents – server schematics which trace the architecture created for Ohio’s then-Republican Secretary of State and state election chief Kenneth Blackwell – raise troubling questions about the security of electronic voting and the integrity of the 2004 presidential election results. 

The flow chart shows how voting information was transferred from Ohio to SmarTech Inc., a Chattanooga Tennessee IT company known for its close association with the Republican Party, before the 2004 election results were displayed online.

Information technology expert Stephen Spoonamore believes this architecture could have made possible a KingPin or “Man in the Middle” (MIM) attack — a well-defined criminal methodology in which a computer is inserted into the network of a bank or credit card processor to intercept and modify transactions before they reach a central computer.

Undervotes: The Scary Canary


In 2004, voters in key states waited in long lines at the polls only to later discover the voting machines did not record their vote for a presidential candidate. This occurrence is known as an undervote. This clip from David Earnhardt’s documentary film, “Uncounted,” focuses on cases of undervoting in the 2004 battleground states of New Mexico and Pennsylvania.

This was an excellent documentary that showed some very disturbing facts about the 2004 election that were never reported on, and never fully investigated. This is just a short clip from that film.

Not much has changed since the 2004 election. We must remain watchful and vigilant this election on Tuesday, and not let this happen again.

Misinformation campaign tells VA Dems to vote on wrong day

One week to go. With the GOP in a state of desperation, how bad will this get? 

Raw Story:

A forged flyer going to voters in a closely fought Virginia congressional district seems aimed at suppressing Democratic turnout on Election Day.

Purporting to come from Virginia’s Board of Elections, the flyer says “All Democratic party supporters and independent voters supporting Democratic candidates shall vote on November 5th.” That’s one day after Election Day. [..]

The article goes on to say it is unclear who is circulating the flyer, but that the state police are investigating. It is clearly targeting Democratic voters..

Polls have showed Obama is pulling away in Virginia in recent weeks, and many analysts say it is becoming more likely he will prevail in the state.

Up to 30,000 voters illegally purged in Colorado

Raw Story:

CBS 4 in Denver reported that election watchdog groups have accused the Republican Secretary of State of illegally purging up to 30,000 voters from voter rolls. The Denver Post reported that 20,000 voters may have been illegally purged.

The Denver Post reported:

“Common Cause of Colorado, Mi Familia Vota Educations Fund and the Service Employees International Union filed a request in U.S. District Court in Denver for a temporary restraining order to bar the state from removing any more voters.”

“The lawsuit also seeks a preliminary injunction to reinstate the names of thousands of voters by Nov. 4 that they say were illegally dropped from the rolls.”

“The lawsuit says that the secretary of state violated the National Voting Rights Act because more than 20,000 voters were purged within the 90-day window before an election, when removal is not allowed under the act.”

“The groups say that 90 days before an election, people cannot be removed unless a voter asks for removal, dies, is declared incapacitated or is convicted of a felony. ”

That last line “90 days before an election, people cannot be removed unless…or is a convicted felon”? That would apply to Senator Ted Stevens of Alaska..

Watchdog Group Sues Colorado Secretary Of State For Illegal Voter Purge

Advancement Project was founded on the principle that structural racism can be eliminated and a racially just democracy may be attained through multi-racial collective action by organized communities.  They are a national voter protection agency, their lawsuit was filed in federal court Friday. It alleges that Coffman violated federal election law in two ways.  Advancement Project is challenging the illegal purges and cancellation practices of  Colorado Secretary of State, Mike Coffman that have removed between 16,000 and 30,000 voters from Colorado’s rolls.

“These purge programs violate a federal law that is intended to protect eligible voters from being swept off the rolls,” said Penda Hair, co-director, Advancement Project. “The state admits engaging in these practices and purging thousands of voters’ registration records without notice. We felt that filing this action was the only way we could ensure that thousands of Colorado residents would not show up at the polls on Election Day only to find they could not participate in this historic national election.”

Advancement Project is challenging two types of purging practices by the state as violations of the National Voting Rights Act (NVRA).

CNN: 50,000 purged from voter rolls in Georgia

College senior Kyla Berry was looking forward to voting in her first presidential election, even carrying her voter registration card in her wallet.

But about two weeks ago, Berry got disturbing news from local election officials.

“This office has received notification from the state of Georgia indicating that you are not a citizen of the United States and therefore, not eligible to vote,” a letter from the Fulton County Department of Registration and Elections said.

But Berry is a U.S. citizen, born in Boston, Massachusetts. She has a passport and a birth certificate to prove it.

Berry is one of more than 50,000 registered Georgia voters who have been “flagged” because of a computer mismatch in their personal identification information. At least 4,500 of those people are having their citizenship questioned and the burden is on them to prove eligibility to vote.

Experts say lists of people with mismatches are often systematically cut, or “purged,” from voter rolls.

I’d be curious to know what percentage of these ‘purged’ voters are minorities, are Democrats, and what percentage are Republicans. There are over 660,000 new registered voters in Ohio, with attempts at purging over 200,000 of those new voters. Again, I would wonder about the same breakdown..

We are not even talking about voter caging and voting machines with no paper trails that “accidently” flip votes..

This is happening all over the US right now in an attempt to prevent Americans from casting their votes. That does not represent a “democracy’.

Sherrod Brown Pushes Back At Bush On Probe Of Ohio Voter Registrations

Ohioans live in a state that it is important that all new voters are welcomed and that all of their votes are accurately counted. We also live in a state that in the last election of 2004, our Secretary of State, Ken Blackwell (R), was eviscerated by the judge in his response over Blackwell’s new directive to suppress votes in Ohio. This is what the judge had to say to Secretary Blackwell, “The exigencies requiring the relief being ordered herein are due to the failure of the defendant to fulfill his duty not only to this Court, as its injunction directed him to do. The Proposed Directive remains…and is every bit as much in violation of HAVA. Blackwell apparently seeks to accomplish the same result in Ohio 2004 that occurred in Florida in 2000.”

There is no grey area in what the judge had to say about Secretary Blackwell’s tactics in 2004. Now we move forward to 2008, Boehner (R) initially sent a letter to Mukasey, when he didn’t respond Boehner directly contacted President George W. Bush. He wants Bush to get involved with the 200,000 new voters to make them either verify information or cast provisional ballots, which we all know are oftentimes thrown out.

In response to this possible suppression of new voters, Sen. Sherrod Brown, D-Ohio, and five congressional lawmakers, urged Attorney General Michael Mukasey not to intervene in Ohio’s voter registration dispute where Republicans have challenged the integrity of 200,000 new voter registration forms.

“The eyes of the nation are once again on Ohio in the Nov. 4 election in this critical election,” Brown and the congressional Democrats said in a letter sent to Mukasey. “We have confidence in the work that is being done by Ohio’s bipartisan group of election officials and by Ohio Secretary of State Jennifer Brunner. We respectfully request that you refrain from taking any action absent more compelling evidence than partisan political requests.

Here, in this shattering new interview, Stephen Spoonamore goes into harrowing detail about the Bush regime’s election fraud, past, present and–if we don’t spread the word right now–to come. Since he’s the only whistle-blower out there who knows the perps themselves, and how they operate, we have to send this new piece far and wide.

Here Spoon tells us that McBush’s team–i.e., Karl Rove and his henchpersons– have their plan in place to steal this next election: by 51.2% of the popular vote, and three electoral votes.

He also talks about the major role played by the Christianist far right in the electronic rigging of the vote.

And he defines our electronic voting system as a major threat to US national security, calling for it to be junked ASAP, in favor of hand-counted paper ballots.

Since Spoon is a Republican and erstwhile McCain supporter, as well as a noted specialist in nosing out computer fraud, his testimony is essential–not only for its expertise, but, no less, for the impact that his views will surely have on those Republicans who have been loath to see what Bush & Co. has done to our election system.

That whole story’s just about to break. In fact, tomorrow there will be a number of articles appearing, on a recent breakthrough in the lawsuit that Spoon’s testimony has enabled, and on other aspects of that all-important case.

Spoonamore says that the GOP wanted e-voting to steal elections but now foreign governments will be hacking and the winner will be determined by the best hackers. He says that if the GOP wins the hacking competition, McCain will win 51.2 percent with three electoral votes over Obama, and it will be a stolen election.

Spoon also makes a crucial point about the people who have been implicated in much of the election theft: “They are religious extremists.” He names those who know about stolen elections, and he insists that the only way to protect this election is with paper ballots, hand-counted.

Been foreclosed on? Sorry, your vote doesn’t count!

In one of the most appalling stories of GOP voter theft, the Republican party in Michigan is planning on using lists of foreclosed houses as a means to challenge voter eligibility on election day. The Michigan Messenger reports:

The chairman of the Republican Party in Macomb County Michigan, a key swing county in a key swing state, is planning to use a list of foreclosed homes to block people from voting in the upcoming election as part of the state GOP’s effort to challenge some voters on Election Day.

“We will have a list of foreclosed homes and will make sure people aren’t voting from those addresses,” party chairman James Carabelli told Michigan Messenger in a telephone interview earlier this week. He said the local party wanted to make sure that proper electoral procedures were followed.

State election rules allow parties to assign “election challengers” to polls to monitor the election. In addition to observing the poll workers, these volunteers can challenge the eligibility of any voter provided they “have a good reason to believe” that the person is not eligible to vote. One allowable reason is that the person is not a “true resident of the city or township.”

The Michigan Republicans’ planned use of foreclosure lists is apparently an attempt to challenge ineligible voters as not being “true residents.”

Of course, this upwards of almost 60% of those affected by foreclosure in MI are African-Americans.

GOP officials elsewhere in Michigan, as well as Ohio, have said they are looking to challenge voter registration based on foreclosure lists – which points to an orchestrated attempt by the McCain campaign to steal the votes of victims of the credit crunch, especially black American victims. This while banks are offered corporate-socialist bailout after bailout and John McCain the 5 Million Dollar Man suggests that common people should miss a holiday or get an extra job to ensure they keep up their payments on a sub-prime loan.

Welcome to the New America. You are allowed to vote if you’re well off. If, however, your government failed you by allowing unscrupulous mortgage bankers to take advantage of you, then, well, you’re not only on your own, but you no longer count. (And I am, in no way, saying that every single person who lost a house was at the hand of the unscrupulous lenders, but a fair amount were). If you lost your job and cannot find another, especially in the hard-hit states of Michigan and Ohio, too bad, you’re on your own and your vote does not count. If your company off-shored your job, tough luck. You have no say in your government.

UPDATE: After mass outrage and the threat of demonstrations, the GOP has backed down from this specific type of voter caging.

When asked whether Michigan Republicans plan to create a challenge list based on returned direct mail, a practice known as “vote caging,” Doster replied, “I think so. I know this has been done in years past … both parties may be doing this.”

Doster said that the party’s deputy political director, Kelly Harrigan, would have more information about the challenge lists. Harrigan did not respond to a call from Michigan Messenger.


Last week Ohio Secretary of State Jennifer Brunner acknowledged that the use of mail for vote caging has disproportionately affected poor and minority communities and she instructed that returned mail should not be considered reasonable evidence that someone has moved.

Nearly 600,000 Subject to Possible Caging in Ohio

How many voter-registration mass mailers are “returned to sender” in the run-up to Election Day may determine how many Ohio residents are eligible to vote.

Ohio election officials are sending out a mass mailer stamped “do not forward” to all registered voters today (Sept. 5) with an absentee ballot application and other important notices for Nov. 4.

What’s important here is not so much what’s going out as what’s being returned to sender.

Unbeknownst to the would-be recipients, the same mailer – just 60 days before the election – has the potential to determine their eligibility to vote, challenged not by election officials but by partisan opposition.

A similar mailer in March netted nondeliverable mail from almost 600,000 registered voters in just five Ohio counties who could now have their ballots thrown out for voting under the wrong address.

The National Voter Registration Act prohibits any state from purging names from the voting rolls within 90 days of an election.

The law doesn’t, however, preclude mass partisan challenges on or shortly before Election Day – known as voter caging – based on the same returned envelopes from state-sponsored mailers like the ones in Ohio and others going out across the country.

Civil Rights Commission Hires Spakovsky to Work on Voting Rights

It looks like Hans von Spakovsky, an old TPM favorite, is back in business. The former Justice Department official, whose nomination to the Federal Election Commission (FEC) was thwarted when Democrats objected to his long record of support for restrictions on voting rights, has been hired as a “consultant and temporary full-time employee” at the ostensibly bi-partisan U.S. Commission on Civil Rights (USCCR) the agency confirmed to TPMmuckraker.

If Spakovsky’s history of backing efforts to make voting more difficult strikes you as a poor fit with the Commission’s mission of defending voter rights, consider that of the eight current commissioners at the agency, only two are registered Democrats, a politicization that the New York Times’ Charlie Savage brought to light last year.

Among Spakovsky’s duties will be overseeing the USCCR’s report on the Justice Department’s monitoring of the 2008 presidential elections, a source inside the USCCR told TPMmuckraker.

Obama Doesn’t Sweat. He should.

In swing-state Colorado, the Republican Secretary of State conducted the biggest purge of voters in history, dumping a fifth of all registrations. Guess their color.

In swing-state Florida, the state is refusing to accept about 85,000 new registrations from voter drives – overwhelming Black voters.

In swing state New Mexico, HALF of the Democrats of Mora, a dirt poor and overwhelmingly Hispanic county, found their registrations disappeared this year, courtesy of a Republican voting contractor.

In swing states Ohio and Nevada, new federal law is knocking out tens of thousands of voters who lost their homes to foreclosure.

My investigations partner spoke directly to Barack Obama about it. (When your partner is Robert F. Kennedy Jr., candidates take your phone call.) The cool, cool Senator Obama told Kennedy he was “concerned” about the integrity of the vote in the Southwest in particular.

He’s concerned. I’m sweating.

It’s time SOMEBODY raised the alarm about these missing voters; not to save Obama’s candidacy – journalists should stay the heck away from partisan endorsements – but raise the alarm to save our sick democracy.

Watch “Free for All

The votes flipped before my eyes…


Brad Friedman has a long, but totally worth the read, post today on his personal experience with voting in the California state primary election, on an ES&S Inkavote Plus Voting System — and having four of his votes flipped right before his eyes. 

Right before my very eyes, the computer-printed ballot produced by the voting system I was using, incorrectly filled in bubbles for four of the races I was voting in. Had I not been incredibly careful, after the ballot was printed out, to painstakingly compare what was printed to what I actually voted for, I’d have never known my votes were being given to candidates I did not vote for.

We’ve been saying electronic voting machines are not tamper-proof for years, and Brad has been following this issue quite closely — now he’s a first hand witness. 

Additionally, this particular voting system is touted as being accessible to blind and disabled voters, but fails miserably.

Luckily, unlike other voters who might need to use the device in order to vote “in a private and independent manner”, I have use of my arms. So I was able to push the buttons on the machine to make my selections and move through the ballot as instructed. Had I not, I would have had to have asked for help from someone. While I could have told my helper which buttons to push for me without them easily being able to figure out who or what I was voting for — they wouldn’t have been able to hear the audio as I heard it on the headphones, and thus, wouldn’t have known which button pushes were selecting which candidates — I would not have been able to vote “independently” as HAVA’s Sec. 301 mandates.

My question is this:  Why have the people not been more on top of the electronic voting issue?  Voting has been the one thing we’ve held up as what makes our system work — one man, one vote.  Sure, there are lots of reasons why those in power would want to disenfranchise voters in any way they can.  We KNOW that.  It’s been happening for years. 

Maybe it’s ok if it happens to “the other guy?”  As long as my vote counts, who cares about the other guy — I don’t agree with him anyway.  Is that it?

Is This How Republicans Plan to Win in November?

The State of Missouri, ever mindful and fearful of illegal immigrants, wants to make sure these illegal immigrants don’t show up at the polls in November and attempt to vote.

The interesting thing is that Missouri law already requires proof of citizenship in order to register to vote. Somehow, the current law just isn’t enough for these Republicans. Fear rules in their world and fear is their only means of controlling others.

Excerpts are from the New York Times:

Supporters of the measures cite growing concerns that illegal immigrants will try to vote. They say proof of citizenship measures are an important way to improve the accuracy of registration rolls and the overall voter confidence in the process.

State Representative Stanley Cox, a Republican from Sedalia and the sponsor of the amendment, said that the Missouri Constitution already required voters to be citizens and that his amendment was simply meant to better enforce that requirement.

From October 2002 to September 2005, the Justice Department indicted 40 voters for registration fraud or illegal voting, 21 of whom were noncitizens, according to department records.

Wow – a whole 21 non-citizens. Now that is a frightening number especially since it happened within a 3 year span. What does that make it, 7 non-citizens/year?

The Missouri Supreme Court already ruled a photo identification law as unconstitutional so now the Missouri lawmakers believe it is time to change the Missouri State Constitution. What this change would do is disenfranchise some elderly who can’t get copies of their birth certificates.

Lillie Lewis, a voter who lives in St. Louis and spoke at a news conference last week organized to oppose the amendment, said she already had a difficult time trying to get a photo ID from the state, which asked her for a birth certificate. Ms. Lewis, who was born in Mississippi and said she was 78 years old, said officials of that state sent her a letter stating that they had no record of her birth.

“That’s downright wrong,” Ms. Lewis said. “I have voted in almost all of the presidential races going back I can’t remember how long, but if they tell me I need a passport or birth certificate that’ll be the end of that.”

A naturalized citizen that comes from a third world country may not have access to an original birth certificate and if they were a refugee, they might not even have a valid passport or their passport may have expired.

So the nuns that were turned away in Indiana may just be the tip of the iceberg. Guaranteed… there will be mores stories like these. After all, how else will Republicans win in November? They have a flip-flopping liar as their presidential nominee who is not inspiring to anyone and who would only bring a third Bush term which would perpetuate all the financial and economic disasters of the past 7 years.

Now, Ed Rendell is the ultimate politician and he’s been very outspoken about pledging his super-delegate to Hillary Clinton.
